Judge Paula Xinis is setting the stage to hold Trump officials in contempt.
Attorneys for Kilmar Abrego Garcia demanded the Trump Administration ‘comply’ with the Supreme Court order and release the MS-13 gang member from the CECOT prison.
In a new court filing on Tuesday Abrego Garcia’s attorneys said the Trump Administration has to at least request his release from the CECOT prison and help ‘facilitate’ his return from El Salvador.
The attorneys said, “There is no evidence that anyone has requested the release of Abrego Garcia.”
“To give any meaning to the Supreme Court’s order, the Government should at least be required to request the release of Abrego Garcia. Id. To date, the Government has not done so,” the attorneys wrote.
The Trump DOJ is currently arguing the meaning of ‘facilitate’ as it relates to immigration cases in response to the Supreme Court order.
Trump’s Justice Department trolled Judge Paula Xinis in a Monday night court filing in the case of deported MS-13 gang member Kilmar Abrego Garcia.
Judge Xinis, an Obama appointee, slammed the Trump Administration during last Friday’s hearing and demanded ‘daily updates’ on Kilmar Abrego Garcia’s whereabouts.
The judge said the Trump Admin has made “no meaningful effort to comply” with her order demanding the physical location and custodial status of Abrego Garcia.
In Monday’s filing, the DOJ didn’t answer Judge Xinis’ questions on Abrego Garcia’s whereabouts. They linked to El Salvador President Bukele’s Oval Office comments on Abrego Garcia.
In Monday’s Oval Office meeting, Bukele said he will not return alleged MS-13 gang member Kilmar Abrego Garcia to the United States.
CNN’s Kaitlan Collins asked Bukele if he plans to return Abrego Garcia after an Obama judge ordered him to be released from the CECOT prison and brought to the US.
“How can I smuggle a terrorist into the United States? Of course I’m not going to do it. The question is preposterous,” Bukele told CNN’s Kaitlan Collins in the Oval Office on Monday.
