A race-baiting judge in California has decided to kneecap our brave border agents from arresting some of the most violent human beings on Earth and ignored a critical federal law in the process.
As Fox News reported, U.S. District Judge Jennifer L. Thurston issued an injunction on Tuesday barring Customs and Border Protection (CBP) agents in the Eastern District of California from stopping illegal immigrants without a warrant or proving that the person is a threat to flee before they can get a warrant.
As the outlet notes, Thurston’s ruling comes after several individuals were arrested in January during Border Patrol’s “Operation Return to Sender.” This was just part of President Trump’s smashing success in removing illegal aliens from the interior while locking down the southern border.
Unsurprisingly, the Marxist American Civil Liberties Union (ACLU) imitated the lawsuit to defend the illegals. They claimed </>in their suit against the Department of Homeland Security (DHS) Secretary Kristi Noem and CBP officials that Border Patrol agents utilized racial profiling to ‘unconstitutionally’ detain people over the span of a week.
The ACLU also said those detained by immigration authorities were taken by bus to the border and held without being able to communicate with family or legal representation. The illegals were also allegedly forced to sign documents waiving their right to see an immigration judge and had voluntarily agreed to leave America.
Thurston, who was nominated by Joe Biden, agreed with the ACLU communists. She wrote in her ruling that the Border Patrol “engaged in conduct that violated well-established constitutional rights.”
Thruston also ordered the Border Patrol to submit a report every 60 days showing who is being held and who was arrested without warrants, along with the reasoning for both, until the lawsuit is resolved.
The Biden judge also whipped out the race card during a hearing a day before her final ruling.
“You just can’t walk up to people with brown skin and say, ‘Give me your papers,’” she said during a heated exchange with Trump administration attorneys on Monday.
For their part, attorneys for the Border Patrol pointed out there was a glaring problem that should had rendered the lawsuit by ACLU moot: Thurston did not have jurisdiction to consider the case because federal law dictates that immigration issues can generally only be appealed once an immigration judge has issued a final order.
The government also said the lawsuit was moot because the U.S. Border Patrol has already issued guidance “detailing exactly when people may be stopped or arrested without warrants, and what rights detainees have after their arrest.”
U.S Senator Mike Lee (R-UT) agreed with the attorneys in statement on X lambasting the ruling, specifically pointing the critical law which authorizes warrantless detainment of illegals.

I cannot fathom the justification for a judicial order prohibiting the Border Patrol from arresting illegal aliens without a warrant.

This is a developing story.
But Thurston ignored their arguments, saying the policy’s new language in the new policy won’t guard against so-called ‘illegal stops.’ She added that the policy could also be changed again in the future.
